When Probate Court Papers are Needed
When the deceased is the sole owner of the vehicle.
Vehicle Titles with two names and both are deceased.
When a Death Certificate Needed
When a Vehicle Title has two owners and one is still living, a Death Certificate must be provided to transfer.
All Vehicle Titles in a trust will need a death certificate and trust paperwork to transfer.
Recording a Will
To record a Will in the Madison County Clerk's Office the individual must be deceased.
All Wills must go through probate in District Court before filing.

After Probate Court, you can file the Will with the Madison County Clerk’s Office.
Our Office is located at 101 W. Main Street, Richmond, KY., in the Madison County Courthouse on the first floor in the Deed Room.
We must receive the original Will with the court order attached.
The cost to record a Will is a flat fee of $8.00.
The Clerk’s office will retain the original copy of the Will indefinitely.
If you would like a copy after the Will has been recorded, the fee is $.25 per page.
A certified copy of a Will is $5.00.
